1. Agreement
These Terms govern your use of Elite 8 Draft Board (the "app"), published by Cyngetik Labs ("we", "us"), on the web at elite8.cyngetiklabs.com and as an Android application. By using the app you agree to these Terms. If you do not agree, please do not use the app.
2. What the app is
The app is a scorekeeping and organisation tool for running a fantasy football draft. It is free to use. We grant you a personal, non-exclusive, revocable licence to use it for that purpose.
The app does not host, operate, or facilitate any fantasy league, contest, wager, or prize. It records the picks you enter. Whatever your league does outside the app — including any entry fees or payouts among its members — is entirely your own arrangement and none of our doing. You are responsible for making sure your league complies with the laws that apply to you.
3. Accounts
You can use the single-device draft board as a guest with no account. An account is required only to join shared draft rooms or to sync your drafts across devices.
If you create one, you agree that:
- The information you give us is accurate, and the email address is one you control.
- You are responsible for what happens under your account, and for keeping your password to yourself. Tell us promptly if you believe someone else has access to it.
- You are at least 13 years old.
- You will not create an account on someone else's behalf without their permission, or run multiple accounts to evade a lock, a ban, or a league's rules.
You can delete your account at any time from inside the app, under Account → Delete my account. Deletion is immediate and permanent.
4. Usernames
Usernames are unique and claimed on a first-come, first-served basis. Choosing one gives you no ownership of it beyond your use of the app, and it becomes available to others if you delete your account or change it.
We may reclaim or rename a username that impersonates another person or organisation, infringes a trademark, is used to mislead, or is offensive — and we may do so without notice where the account is being used abusively.
5. Acceptable use
When using shared draft rooms, usernames, and chat, you agree not to:
- Post content that is unlawful, harassing, hateful, threatening, defamatory, or obscene.
- Impersonate another person, or misrepresent who you are.
- Post other people's personal information without their permission.
- Attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the app, other people's accounts, or its infrastructure.
- Deliberately enter or disrupt draft rooms you have not been invited to.
- Use the app for any unlawful purpose, including unlawful gambling.
Chat is not moderated. We do not review, filter, or monitor messages in draft rooms. Content in a room comes from the people in it, not from us, and we are not responsible for it. If a room's chat becomes a problem, lock or abandon the room and start a new one.
We may remove content, suspend an account, or block access where we believe it is necessary — for example in response to a legal request or a report of abuse — but we have no obligation to monitor anything, and no ability to do so proactively.
6. Draft rooms and your content
You keep ownership of everything you enter — team names, picks, chat messages. By putting it in a shared draft room you grant us the limited technical permission needed to store and transmit it to the other people in that room, which is the only way a shared room can function.
Rooms are secured only by their code. While a league is unlocked, anyone signed in who has the room code can enter it. If you list your league publicly, its code is visible to everyone browsing the public list. Lock your league once your players have joined. See the Privacy Policy for the detail.
The host of a draft can delete it for everyone. Any player can leave a draft they have joined. We may also delete drafts that are inactive, abusive, or consuming unreasonable resources. Do not treat a draft room as a backup — export your board to CSV if it matters to you.
7. No affiliation with the NFL
Elite 8 Draft Board is not affiliated with, endorsed by, sponsored by, or connected to the National Football League, any NFL team, the NFL Players Association, or any other league or governing body. All team names, player names, and related marks are the property of their respective owners and are used here solely to identify real people and teams for the purpose of running a fantasy draft.
8. Player data
Player names, positions, teams, and bye weeks are retrieved from a third-party public roster feed. We do not control that data and cannot guarantee it is accurate, complete, or up to date. It is provided as-is. Verify anything that matters to your league before relying on it.
9. No warranty
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that data stored in it will be preserved.
Guest drafts are stored in your browser's local storage, which you or your device can clear at any time. Keep your own record of anything you cannot afford to lose — the CSV export exists for exactly this.
10. Suspension and termination
You may stop using the app at any time and delete your account from within it. We may suspend or terminate an account that breaches these Terms, or where we are required to by law. Where it is reasonable to do so, we will tell you why.
11. Limitation of liability
To the fullest extent permitted by law, Cyngetik Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, drafts, profits, or goodwill, arising out of or relating to your use of the app — including any dispute within your league, any lost or altered draft, and any content posted by another user.
The app is free, and our total aggregate liability to you for any claim relating to it will not exceed one hundred United States dollars (USD $100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.
12. Changes and availability
We may modify, suspend, or discontinue the app or any part of it at any time. We may also update these Terms; if we do, we will change the effective date above, and material changes will be made clear in the app. Continuing to use the app after a change means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the United States and of the state in which Cyngetik Labs is established, without regard to conflict-of-law principles. If any provision is found unenforceable, the rest remains in force.
